§ 10 SDSG
Restriction of the duty to inform when collecting
(1)personal data pursuant to Articles 13 and 14 of Regulation (EU) 2016/679
(2)When collecting personal data, the controller shall refrain from informing the data subject pursuant to Articles 13 and 14(1) and (2) of Regulation (EU) 2016/679 insofar as and for as long as 1. the disclosure of the information would endanger public security or be detrimental to the welfare of the Federation or a Land, 2. the prevention, investigation, detection or prosecution of criminal offences or administrative offences would be jeopardised, or 3. the personal data or the fact of their processing must be kept secret for the protection of the data subject or the rights and freedoms of other persons.
(3)Where the provision of information relates to the transmission of personal data to public prosecution offices, police departments and other bodies responsible for the prevention, investigation, detection or prosecution of criminal offences, constitutional protection authorities, the Federal Intelligence Service or the Military Counter-Intelligence Service, the consent of these bodies shall be obtained.
