Processing of personal data for scientific or historical research purposes
(1)1The processing of personal data, including data referred to in Article 9(1) of Regulation (EU) 2016/679, for specific scientific or historical research purposes shall be lawful insofar as this is necessary for the conduct of the scientific or historical research, in particular where the purpose of the research cannot be achieved by other means or only with disproportionate effort, and where the public interest, in particular the scientific or historical interest, in the conduct of the research project substantially outweighs the interest of the data subject in the prevention of such processing. 2When processing personal data for specific scientific or historical research purposes, the data shall be anonymised as soon as the research purpose permits. 3Where this is not possible, they shall be pseudonymised. 4The features by means of which a personal reference can be established shall be stored separately. 5The features shall be erased as soon as the research purpose permits.
(2)1Insofar as the provisions of this Act do not apply to the recipient of the data, personal data may only be transmitted to such a recipient where the recipient undertakes to process the transmitted data only for the already specified research purposes and to comply with the provisions of paragraphs 1 and 3. 2The transmitting body shall inform the State Commissioner for Data Protection.
(3)Bodies conducting scientific or historical research may, without prejudice to Article 6(1)(a) of Regulation (EU) 2016/679, only publish personal data insofar as this is indispensable for the presentation of research findings on events of contemporary history and the overriding legitimate interests of the data subject do not preclude such publication.
(4)A right of access pursuant to Article 15, of rectification pursuant to Article 16, of restriction of processing pursuant to Article 18 and of objection pursuant to Article 21 of Regulation (EU) 2016/679 shall not apply insofar as and for as long as the exercise of these rights is likely to render the scientific or historical research purposes impossible or seriously impair them. zur Einzelansicht § 23
