Responsibility in the case of transmission of personal data
(1)1The responsibility for the lawfulness of the transmission of personal data shall lie with the transmitting body. 2Where the transmission takes place at the request of a public body, the latter shall bear the responsibility. 3In that case, the transmitting body shall merely verify whether the request for transmission falls within the scope of the recipient's tasks. 4The transmitting body shall only verify the lawfulness of the request where there is reason to do so in the individual case; the requesting body shall provide the transmitting body with the information necessary for this verification in the request.
(2)Where the transmission takes place by means of automated retrieval, the responsibility for the lawfulness of the retrieval shall lie with the recipient.
(3)Where personal data processed on the basis of legal provisions within the meaning of Article 6(1)(c) or (e) of Regulation (EU) 2016/679 are linked in files with further personal data of the data subject or of third parties in such a way that separation is not possible or is only possible with disproportionate effort, the transmission of such data to public bodies shall also be lawful, unless the rights and freedoms of the data subject or other persons in maintaining the confidentiality of such data outweigh the interest in transmission; any further processing of such data shall be unlawful. zur Einzelansicht § 6
