§ 9 SDSG

Processing of personal data for purposes of parliamentary scrutiny

(1)1The state government may process personal data, including data within the meaning of Article 9(1) of Regulation (EU) 2016/679, to the extent necessary for answering parliamentary questions and for the submission of documents and reports to the state parliament. 2A transmission of data for one of the purposes referred to in sentence 1 shall not be lawful where, due to the strictly personal nature of the data, this would be unreasonable for the data subject or where the interference with his or her right to informational self-determination would be disproportionate. 3This shall not apply where, with regard to Section 2(2) or through other appropriate measures, it is ensured that the legitimate interests of the data subjects are not impaired. 4Special statutory prohibitions on transmission shall remain unaffected.
