Art. 12 BayDSG
Official Data Protection Officers (on Art. 35 para. 2, Art. 37 to 39 GDPR)
(1)Official data protection officers shall in particular receive
(2)access to the record pursuant to Art. 30 GDPR, and
(3)the opportunity to comment before the initial use or a material change to an automated procedure for the processing of personal data.
(4)Art. 24 para. 5 shall remain unaffected.
(5)Official data protection officers shall not disclose facts entrusted to them in the exercise of their function or the identity of the persons who communicated such facts without their consent.
(6)Official data protection officers of state authorities may be appointed by a higher authority.
