Art. 3 BayDSG
Ensuring Data Protection, Controller (on Art. 4 No. 7 GDPR)
(1)The State Chancellery, the State Ministries and other supreme state authorities, the municipalities, the municipal associations and other legal persons under public law subject to the supervision of the Free State of Bavaria, as well as the private-law associations to which this Act applies pursuant to Art. 1 paras. 1 and 2, shall ensure the implementation of the GDPR, this Act and other legal provisions on data protection within their respective areas.
(2)The controller for the processing of personal data within the meaning of the GDPR shall be the public body responsible for the processing, unless otherwise specified.
