Art. 17 BayDSG

Data Protection Commission

(1)The Landtag shall establish a Data Protection Commission to support the State Commissioner. It shall consist of ten members. The Landtag shall appoint six members from among its members in proportion to the strength of its parliamentary groups; the Sainte-Lague/Schepers method shall be applied. For parliamentary groups that do not obtain a seat under this method, the Landtag may appoint one additional member each, even if this increases the number of members beyond sentence 2. The Landtag shall also appoint one additional member each upon the proposal of
(2)the State Government,
(3)the municipal umbrella organisations,
(4)the State Ministry for Health, Care and Prevention from the field of statutory social insurance carriers, and
(5)the Association of Liberal Professions in Bavaria (Verband freier Berufe in Bayern e.V.).
(6)For each member of the Data Protection Commission, a deputy member shall be appointed at the same time.
(7)The members of the Data Protection Commission shall be appointed for the duration of the Landtag's electoral term; they shall not be bound by instructions or directives in the exercise of their function.
(8)The Data Protection Commission shall meet at the request of any of its members or of the State Commissioner. A member of the Landtag shall preside. The Data Protection Commission shall adopt its own rules of procedure.
(9)The members of the Data Protection Commission shall maintain confidentiality, including after their departure, regarding matters that became known to them in the course of their activity. This shall not apply to facts that are publicly known or that, by their significance, do not require confidentiality.
(10)The members of the Data Protection Commission shall receive travel expense reimbursement from the State Commissioner in accordance with the provisions of the Bavarian Travel Expenses Act, as honorary officials.
