Appointment and Tasks (on Art. 51 to 58 GDPR)
(1)The State Commissioner pursuant to Art. 33a of the Constitution shall be the competent supervisory authority under Art. 51 GDPR and shall supervise compliance with this Act and other data protection provisions by public bodies. The State Commissioner shall be a civil servant appointed for a fixed term. Appointment, dismissal and removal from office shall be effected by the President of the Landtag.
(2)The supervision by the State Commissioner shall not extend to files relating to a security clearance, insofar as the data subjects have objected to the supervision in writing to the controller. The controller shall inform data subjects in general terms of their right of objection pursuant to sentence 1.
(3)The Landtag or the State Government may request the State Commissioner, without prejudice to his independence, to comment on specific matters within his area of responsibility.
(4)The State Commissioner shall be supported by an office which shall be established at the Landtag. Administrative matters of the office shall be handled by the Landtag Office, insofar as they do not fall within the competence of the State Commissioner.
