Processing of personal data for scientific or historical research purposes
(1)The processing of personal data, including data referred to in Article 9(1) of Regulation (EU) 2016/679, for scientific or historical research purposes shall be lawful insofar as this is necessary for the conduct of the scientific or historical research, in particular where the purpose of the research cannot be achieved by other means or only with disproportionate effort, and where the public interest, in particular the scientific or historical interest, in the conduct of the research project outweighs the interest of the data subject in the prevention of such processing.
(2)1Section 11(2) shall apply accordingly. 2In addition, insofar as the research purpose permits, the features by means of which a personal reference can be established shall be stored separately; the features shall be erased as soon as the research purpose permits.
(3)Insofar as the provisions of this Act do not apply to the recipient of the data, personal data may only be transmitted to such a recipient where the recipient undertakes to process the transmitted data only for research purposes and to comply with the provisions of paragraphs 2 and 4.
(4)Bodies conducting scientific or historical research may, without prejudice to Article 6(1)(a) of Regulation (EU) 2016/679, only publish personal data insofar as this is indispensable for the presentation of research findings on events of contemporary history and the legitimate interests of the data subject do not preclude such publication.
(5)The rights of access pursuant to Article 15 of Regulation (EU) 2016/679, of rectification pursuant to Article 16 of Regulation (EU) 2016/679, of restriction of processing pursuant to Article 18 of Regulation (EU) 2016/679 and of objection pursuant to Article 21 of Regulation (EU) 2016/679 shall not apply insofar as the exercise of these rights would render the specific research purposes impossible or seriously impair them and such restriction is necessary for the fulfilment of the research purposes.
