§ 9 SächsDSG

Restriction of the right of access

(1)The right of access pursuant to Article 15 of Regulation (EU) 2016/679 shall not apply insofar as
(2)1The decision to refuse access need not be substantiated insofar as the reasons for refusal would jeopardise the purpose of the refusal. 2In such a case, the data subject shall be informed that they may lodge a complaint with the Saxon Data Protection Commissioner. 3The Saxon Data Protection Commissioner shall, at the request of the data subject, be provided with the information. 4The notification from the Saxon Data Protection Commissioner to the data subject shall not allow any conclusions to be drawn as to the knowledge of the controller, unless the controller consents to more extensive disclosure.
(3)Where the right of access relates to the transmission of personal data to public prosecution offices, police departments and other bodies responsible for the prosecution of criminal offences, constitutional protection authorities, the Federal Intelligence Service or the Military Counter-Intelligence Service, these bodies shall be given the opportunity to comment in advance.
