§ 19 SächsDSG
Powers
(1)The Saxon Data Protection Commissioner and his or her staff shall be authorised, in the performance of their duties, to enter official premises at any time and to obtain access to all data processing systems and devices.
(2)Where the Saxon Data Protection Commissioner identifies a criminal violation of this Act or other data protection provisions, the Commissioner shall be authorised to report this to the competent authority.
(3)The power to impose fines shall only be vested in the Saxon Data Protection Commissioner in relation to authorities and public bodies within the meaning of Section 2(1) and (2) insofar as they participate in competition as enterprises.
