§ 15 SächsDSG
Establishment
(1)The Saxon Data Protection Commissioner shall be a supreme state authority with its seat in Dresden.
(2)The civil servants and employees of the Saxon Data Protection Commissioner shall be civil servants and employees of the Free State of Saxony.
(3)The Saxon Data Protection Commissioner shall be the superior and supreme service authority of his or her staff.
(4)1The Saxon Data Protection Commissioner shall appoint and dismiss his or her civil servants. 2The Commissioner shall also be responsible for the hiring and dismissal of his or her employees. 3The personnel and material resources shall be provided within the framework of the positions and funds approved by the budgetary legislator.
(5)The Saxon Data Protection Commissioner shall be subject to the audit by the Saxon Court of Auditors, insofar as this does not impair his or her independence within the meaning of Article 52(1) of Regulation (EU) 2016/679.
