Judicial remedy
(1)For disputes between a natural or legal person and a supervisory authority of the Federation or a Land concerning rights under Article 78 Subsections (1) and (2) of Regulation (EU) 2016/679 and Section 61, the administrative courts shall have jurisdiction. The first sentence shall not apply to administrative fine proceedings.
(2)The Code of Administrative Court Procedure shall apply subject to the provisions of Subsections (3) to (7).
(3)For proceedings under Subsection (1), first sentence, the administrative court in whose district the supervisory authority has its seat shall have local jurisdiction.
(4)In proceedings under Subsection (1), first sentence, the supervisory authority shall have capacity to be a party to the proceedings.
(5)Parties to proceedings under Subsection (1), first sentence, shall beSection 63 Nos. 3 and 4 of the Code of Administrative Court Procedure shall remain unaffected. 1 the natural or legal person as plaintiff or applicant and; 2 the supervisory authority as defendant or respondent.
(6)Preliminary proceedings shall not take place.
(7)The supervisory authority may not order immediate enforcement pursuant to Section 80 Subsection (2), first sentence, No. 4 of the Code of Administrative Court Procedure against an authority or its legal entity.
