§ 60 BDSG
Lodging a complaint with the Federal Commissioner
(1)A person who considers that his or her rights have been violated by the Federal Commissioner during the processing of his or her personal data pursuant to Sections 57 and 58 of this Act may lodge a complaint with the Federal Commissioner.
(2)Where the complaint concerns a decision by a court concerning data processing for the purpose of its judicial activity, the Federal Commissioner shall draw the data subject's attention to the right to request a judicial decision.
