Consumer credits
(1)A controller which grants a consumer credit within the meaning of Section 491 of the Civil Code or wishes to change or supplement the conditions of such a credit to the detriment of the borrower shall, prior to the granting, change or supplement, request information from a credit agency which is accessible to the public for this purpose and shall properly take into account the information received. If the controller requests information within the scope of a scoring procedure, the requirements of Section 31 shall be met in addition.
(2)Where the controller concludes a contract concerning a consumer credit within the meaning of Section 491 of the Civil Code, it shall, without undue delay, inform the borrower about the information it has received, with respect to the data referred to in Subsection (1), first sentence. This shall not apply where the information is provided within the scope of a pre-contractual information obligation.
