§ 12 NDSG

Processing of personal data in service and employment relationships

(1)The civil service provisions on the maintenance of personnel files of § 50 of the Civil Service Status Act and of §§ 88 to 95 of the Lower Saxony Civil Service Act (NBG) shall apply mutatis mutandis to all non-civil-servant employees of a public body, unless otherwise regulated by collective agreement.
(2)1Where determinations regarding the suitability of an applicant for a service or employment relationship are made by means of medical or psychological examinations or tests, the employing authority may as a rule only request from the examining person or body the result of the suitability examination and findings on factors that may impair fitness for health purposes. 2It may request further personal data only if it has previously informed the applicant in writing of the reasons therefor.
(3)1§ 108a(1) sentence 1 numbers 2 to 4 and sentences 2 to 5 and paragraph 2 NBG shall apply mutatis mutandis to all applicants for employment, training or internship relationships at a police authority or the Lower Saxony Police Academy, where that authority is the employing authority. 2The provisions of the Lower Saxony Security Vetting Act shall remain unaffected.
