§ 22 NDSG
Supervisory authority for data processing outside the scope of application of the provisions of this Part
(1)1The authority headed by the Land Commissioner for Data Protection shall also be the supervisory authority within the meaning of Article 51(1) of the General Data Protection Regulation in conjunction with § 40 of the Federal Data Protection Act
(2)for data processing by non-public bodies, and
(3)for data processing by public bodies insofar as the provisions of the Federal Data Protection Act applicable to non-public bodies are to be applied pursuant to § 1(4) or (5).
(4)2The authority headed by the Land Commissioner for Data Protection shall in that context also perform its tasks and exercise its powers as supervisory authority under the General Data Protection Regulation with regard to other data protection provisions.
