§ 2 NDSG
Extended application of the General Data Protection Regulation
(1)The provisions of the General Data Protection Regulation shall also apply
(2)with the exception of Articles 30, 35 and 36 of the General Data Protection Regulation, beyond Article 2(1) of the General Data Protection Regulation, to the non-automated processing of personal data which are neither stored in a filing system nor intended to be stored in a filing system, and
(3)beyond Article 2(2)(a) of the General Data Protection Regulation, to the processing of personal data
(4)for the purpose of preparing public awards and honours, unless otherwise provided in § 15(2),
(5)in clemency proceedings, unless otherwise provided in § 16 sentence 2, and
(6)in the context of other activities not falling within the material scope of application of Union law and not falling under Article 2(2)(b) to (d) of the General Data Protection Regulation, insofar as the data processing is not specifically regulated by a legal provision.
