§ 20a NDSG
Competences and powers for the Telecommunications Telemedia Data Protection Act
(1)The authority headed by the Land Commissioner for Data Protection shall monitor compliance with the provisions of §§ 19 to 25 of the Telecommunications Telemedia Data Protection Act (TTDSG) of 23 June 2021 (BGBl. I p. 1982; 2022 p. 1045), last amended by Article 4 of the Act of 12 August 2021 (BGBl. I p. 3544), in the version in force from time to time, within its area.
(2)With regard to the powers of the authority headed by the Land Commissioner for Data Protection in the context of its supervisory activities concerning compliance with the provisions of the Telecommunications Telemedia Data Protection Act, Article 58 of the General Data Protection Regulation shall apply mutatis mutandis.
(3)The authority headed by the Land Commissioner for Data Protection shall be the administrative authority within the meaning of § 36(1) number 1 of the Act on Administrative Offences (OWiG) in the version of 19 February 1987 (BGBl. I p. 602), last amended by Article 5 of the Act of 14 March 2023 (BGBl. 2023 I No. 73), in the version in force from time to time, in the cases of § 28(1) numbers 10 to 13 TTDSG, unless the Federal Commissioner for Data Protection and Freedom of Information is the administrative authority within the meaning of § 36(1) number 1 OWiG pursuant to § 28(3) number 2 TTDSG.
