Transitional provision
(1)1The Land Commissioner for Data Protection holding office on 24 May 2018 shall be deemed to have been appointed pursuant to § 18(3) sentence 1 and § 57(1) for the remainder of his or her term of office. 2His or her legal status as well as tasks and powers shall, within the scope of application of Part One, be governed by the provisions of the General Data Protection Regulation and §§ 18 to 22, and within the scope of application of Part Two, by § 57.
(2)Within the scope of application of Part Two, automated processing systems established before 6 May 2016 shall be brought into compliance with § 35(2) and (3) promptly, and in exceptional cases where this would involve disproportionate effort, no later than 6 May 2023.
