§ 60 NDSG
Criminal offences
(1)Any person who commits an act referred to in § 59(1) for remuneration or with the intention of enriching himself or herself or another person or of causing harm to another person shall be punished with imprisonment for a term not exceeding two years or with a fine. The same punishment shall apply to any person who, under the conditions referred to in sentence 1, combines individual data relating to personal or factual circumstances of a person who is no longer identifiable and thereby renders the person identifiable again.
(2)Attempt shall be punishable.
(3)The offence shall be prosecuted only upon application. The data subject, the controller, the processor and the authority headed by the Land Commissioner for Data Protection shall be entitled to file such an application.
