§ 12 HmbDSG
Data processing for artistic purposes
(1)Insofar as personal data are processed for artistic purposes, only Article 5(1)(b) and (f) as well as Articles 24, 32 and 33 of Chapters II to VII and IX of Regulation (EU) 2016/679 shall apply.
(2)Where the processing of personal data pursuant to paragraph 1 leads to the dissemination of counter-statements by the data subject or to declarations of undertaking, court decisions on the cessation of dissemination or on the revocation of the content of the data, such counter-statements, declarations of undertaking, court decisions and revocations shall be added to the stored data and kept there for the same period as the data themselves, and shall be disclosed together with the data upon any disclosure of the data.
