§ 23 HmbDSG
Activities after termination of the official relationship
(1)The Hamburg Commissioner for Data Protection and Freedom of Information shall, for a period of two years after the end of the term of office, refrain from all acts and paid activities that are incompatible with the duties of the former office.
(2)Former Hamburg Commissioners for Data Protection and Freedom of Information shall notify the incumbent Hamburg Commissioner for Data Protection and Freedom of Information in writing of the taking up of any gainful employment or other permanent occupation outside the public service, public enterprises, or public-law corporations, institutions and foundations. The obligation to notify shall exist for a period of two years after the end of the official relationship.
(3)The incumbent Hamburg Commissioner for Data Protection and Freedom of Information shall prohibit the gainful employment or other permanent occupation insofar as it is incompatible with the office of the Hamburg Commissioner for Data Protection and Freedom of Information. The prohibition shall be issued within fourteen days of receipt of the notification pursuant to paragraph 1 and for a specified period. The prohibition shall end at the latest upon expiry of two years after the end of the official relationship.
(4)In the case of freelance activities, the relevant provisions of the professional codes of conduct for the avoidance of conflicts of interest shall be observed; they shall take precedence over this regulation. zur Einzelansicht § 23
