Responsibility in the disclosure of personal data
(1)The responsibility for the lawfulness of a disclosure of personal data by means of their transmission, dissemination or any other form of making available shall be borne by the disclosing body.
(2)Where a disclosure of personal data by means of their transmission, dissemination or any other form of making available takes place on the basis of a request by a public body, that body shall bear responsibility for compliance with data protection. The disclosing body shall only verify whether the request falls within the scope of the tasks of the recipient, unless there is reason in the individual case to verify the lawfulness of the data processing. The requesting body shall provide in the request the information necessary for this verification.
(3)Where an automated retrieval procedure is used, the retrieving body shall bear responsibility for the lawfulness of the retrieval. zur Einzelansicht § 8 Dritter Abschnitt Besondere Verarbeitungssituationen
