§ 20 HmbDSG

Appointment requirements

(1)The Hamburg Commissioner for Data Protection and Freedom of Information must possess the qualification for judicial office or for the career track of General Services in career group 2 with access to the second entry level and must possess the professional expertise necessary for the performance of his or her duties. zur Einzelansicht § 20 § 211) Rechtsstellung
(2)The Hamburg Commissioner for Data Protection and Freedom of Information shall hold a public-law official relationship with the Free and Hanseatic City of Hamburg, into which he or she is appointed pursuant to Article 60a(3) of the Constitution of the Free and Hanseatic City of Hamburg.
(3)The official relationship shall begin upon delivery of the certificate of appointment by the President of the Parliament. The Hamburg Commissioner for Data Protection and Freedom of Information shall take the following oath before the President of the Parliament: "I swear to uphold the Basic Law for the Federal Republic of Germany, the Constitution of the Free and Hanseatic City of Hamburg and all laws in force in the Federal Republic of Germany, and to fulfil my official duties conscientiously, so help me God." The oath may also be taken without the religious affirmation.
(4)The official relationship shall end upon expiry of the term of office or by dismissal. The dismissal shall take effect upon delivery of the certificate of dismissal.
(5)In the event of his or her prevention, the Hamburg Commissioner for Data Protection and Freedom of Information shall designate a civil servant of his or her authority as deputy. The power of representation shall continue after the end of the term of office of the Hamburg Commissioner for Data Protection and Freedom of Information until the appointment of a successor.
(6)The Hamburg Commissioner for Data Protection and Freedom of Information shall receive care and protection equivalent to that of a civil servant of pay grade B 4 of the Hamburg Remuneration Act of 26 January 2010 (HmbGVBl. p. 23), last amended on 18 July 2017 (HmbGVBl. p. 214), as amended from time to time, in a civil service relationship for a fixed term, in particular with regard to remuneration, pension, annual leave and assistance in the event of illness. The Commissioner shall notify his or her deputy of the taking of leave.
(7)The Hamburg Commissioner for Data Protection and Freedom of Information shall be subject to audit by the Court of Audit only insofar as his or her independence is not impaired. Fußnoten 1) [Red.
