Restriction of the duty to provide information
(1)Information pursuant to Article 13 or 14 of Regulation (EU) 2016/679 shall not be provided to the extent and for as long as 1. the provision of information would endanger public safety or otherwise be detrimental to the welfare of the Federation or of a Land, 2. the fact of the processing must be kept secret pursuant to a legal provision or because of the rights and freedoms of other persons, 3. this is necessary for the prosecution of criminal offences and administrative offences, 4. this would impair the assertion, exercise or defence of legal claims and the interests of the controller in not providing the information outweigh the interests of the data subject, or 5. a further processing of data stored in analogue form is carried out in which the controller directly addresses the data subject, the purpose is compatible with the original purpose of collection pursuant to Regulation (EU) 2016/679, the communication with the data subject does not take place in digital form, and the interest of the data subject in receiving the information is to be regarded as minor in view of the circumstances of the individual case, in particular the context in which the data were collected.
(2)Where the provision of information relates to the transmission of personal data to authorities and bodies of the public prosecutor's office, the police, the Land tax authorities insofar as they store personal data in the performance of their statutory tasks within the scope of application of the Fiscal Code for the purposes of monitoring and auditing, the authorities for the protection of the constitution, the Federal Intelligence Service, the Military Counter-Intelligence Service and, insofar as the security of the Federation is concerned, other authorities of the Federal Ministry of Defence, agreement with these authorities shall be obtained beforehand.
(3)Where information is withheld from the data subject pursuant to paragraph 1, numbers 1 to 3 and 5, or paragraph 2, the controller shall document the reasons therefor. zur Einzelansicht § 15
