Scope of Application of the Act
(1)This Act regulates 1 the secrecy of telecommunications, including the prohibition of interception and the duty of confidentiality of operators of radio installations,; 2 specific provisions for the protection of personal data in the use of telecommunications services and digital services,; 3 the requirements for the protection of privacy with regard to the notification of incoming connections, the suppression and display of calling line identification, and automatic call forwarding,; 4 the requirements for inclusion in end-user directories and the provision of end-user data to directory enquiry services, services for notification of an individual communication request of another user, and providers of end-user directories,; 5 the technical and organisational measures to be observed by providers of digital services,; 6 the requirements for the provision of information on inventory data and usage data by providers of digital services,; 7 the protection of privacy in relation to terminal equipment with regard to the requirements for the storage of information in end-users' terminal equipment and the access to information already stored in end-users' terminal equipment, and; 8 the supervisory authorities and the supervision with regard to data protection and the protection of privacy in telecommunications; for digital services, the supervision by the authorities competent under Land law and Section 40 of the Federal Data Protection Act shall remain unaffected.
(2)Individual data subject to the secrecy of telecommunications relating to the circumstances of a specific or identifiable legal person or partnership endowed with the capacity to acquire rights or incur obligations shall be treated in the same way as personal data.
(3)This Act applies to all undertakings and persons that have an establishment within the territorial scope of this Act or provide services or participate in the provision thereof or make goods available on the market. Section 3 of the Digital Services Act shall remain unaffected.
