§ 30 TDDDG

Competence, Duties, and Powers of the Federal Network Agency

(1)The Federal Network Agency shall be the competent supervisory authority for compliance with the provisions in Part 2, insofar as the competence of the Federal Commissioner for Data Protection and Freedom of Information is not established under Section 29.
(2)The Federal Network Agency may issue orders and take other measures to ensure compliance with the provisions of Part 2. The person obliged under the provisions of Part 2 must, upon request of the Federal Network Agency, provide the information necessary for this purpose. The Federal Network Agency is authorised to enter and inspect business premises and offices during normal business or office hours for the purpose of verifying compliance with the obligations.
(3)In addition to the power to issue orders under paragraph 2, the Federal Network Agency may, in the event of non-fulfilment of obligations under Part 2, prohibit wholly or partly the operation of affected telecommunications installations or the provision of the relevant telecommunications service where less intrusive measures are insufficient to enforce lawful conduct.
(4)For the enforcement of measures and orders under paragraphs 2 and 3, a coercive payment of up to 1 million euros may be imposed in accordance with the Administrative Enforcement Act.
(5)The secrecy of telecommunications under Article 10 of the Basic Law shall be restricted insofar as the exercise of the powers under paragraph 2 sentences 1 and 3 so requires.
