§ 2 TDDDG
Definitions
(1)The definitions of the Telecommunications Act, the Digital Services Act, and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) shall also apply to this Act, unless a different definition is provided in paragraph 2.
(2)For the purposes of this Act, the following definitions apply: 1 "provider of digital services" means any natural or legal person who provides, participates in the provision of, or mediates access to the use of their own or third-party digital services,; 2 "inventory data" within the meaning of Part 3 of this Act means personal data the processing of which is necessary for the purpose of establishing, structuring the content of, or modifying a contractual relationship between the provider of digital services and the user regarding the use of digital services,; 3 "usage data" means personal data of a user of digital services the processing of which is necessary to enable the use of digital services and to bill for them; this includes in particular
a)characteristics for identification of the user,;
b)information on the beginning and end and the extent of the respective use, and;
c)information on the digital services used by the user,; 4 "message" means any information exchanged or forwarded between a finite number of parties via a telecommunications service; this excludes information that is forwarded to the public as part of a broadcasting service via a public telecommunications network, insofar as the information cannot be linked to the identifiable user who receives it,; 5 "value-added service" means any additional service made available by a provider of a telecommunications service that requires the processing of traffic data or location data other than traffic data to an extent that goes beyond what is necessary for the transmission of a message or for billing of the telecommunications service,; 6 "terminal equipment" means any equipment directly or indirectly connected to the interface of a public telecommunications network for the purpose of sending, processing, or receiving messages; for both direct and indirect connections, the connection may be made by wire, optical fibre, or electromagnetically; in the case of an indirect connection, a device is interposed between the terminal equipment and the interface of the public network.
