§ 6 TDDDG

Message Transmission with Intermediate Storage

(1)Persons obliged under Section 3(2) sentence 1 Nos. 1 and 2 may, in the case of services for the operation of which intermediate storage is necessary, process message content, in particular voice, audio, text, and graphic communications of end users, within the framework of a service offering directed at such purpose, if 1 the processing takes place exclusively in the telecommunications installations of the intermediately storing provider, unless the message content is forwarded to telecommunications installations of other providers on behalf of or through input by the end user;; 2 only the end user
a)determines by his or her input the content, scope, and nature of the processing, and;
b)determines who may input message content and access it, and; 3 the person obliged
a)may notify the end user that the recipient has accessed the message, and;
b)may only delete message content in accordance with the contract concluded with the end user.
(2)Persons obliged under Section 3(2) sentence 1 Nos. 1 and 2 shall take the necessary technical and organisational measures to prevent erroneous transmission and the unauthorised disclosure of message content within the undertaking of the provider and to third parties. Measures are only necessary if the effort involved is proportionate to the intended protective purpose. Insofar as this is necessary with regard to the intended protective purpose, the measures shall be adapted to the state of the art.
