§ 29 TDDDG
Competence, Duties, and Powers of the Federal Commissioner for Data Protection and Freedom of Information
(1)Insofar as data of natural or legal persons are processed for the commercial provision of telecommunications services, the Federal Commissioner for Data Protection and Freedom of Information shall be the competent supervisory authority.
(2)Where the storage of information in the end user's terminal equipment or the access to information already stored in the terminal equipment is carried out by providers of telecommunications services or by federal public bodies, the Federal Commissioner for Data Protection and Freedom of Information shall be the competent supervisory authority for compliance with Section 25.
(3)With regard to the powers of the Federal Commissioner for Data Protection and Freedom of Information in the context of his or her supervisory activity over compliance with the provisions of this Act, Article 58 of Regulation (EU) 2016/679 shall apply accordingly.
(4)The secrecy of telecommunications under Article 10 of the Basic Law shall be restricted insofar as the exercise of the powers under paragraph 3 so requires.
