§ 13 LDSG SH

(1)Data processing for scientific or historical research purposes and for statistical purposes
(2)Public bodies may process personal data, including data within the meaning of Article 9(1) of Regulation (EU) 2016/679, without consent for scientific or historical research purposes or for statistical purposes where 1. the legitimate interests of the data subject are not impaired due to the public nature of the data or the manner of their use, or 2. the public interest in the processing outweighs the legitimate interests of the data subject and the research or statistical purpose cannot be achieved otherwise or only with disproportionate effort. The transmitted data may not be processed for purposes other than research or statistical purposes.
(3)In addition to the measures referred to in § 12, personal data processed for scientific or historical research purposes or for statistical purposes shall be altered so that individual data relating to personal or factual circumstances can no longer be attributed, or only with disproportionately great effort, to a specific or identifiable natural person (anonymisation), as soon as the research or statistical purpose permits, unless the legitimate interests of the data subject are opposed thereto. Until then, the identifying features shall be pseudonymised. They may only be combined with individual data insofar as the research or statistical purpose so requires.
(4)Personal data within the meaning of paragraph 1 sentence 1 may also be transmitted to recipients who are not subject to the provisions of this Act, provided that they undertake to process the data only for the research or statistical project they have specified and in accordance with paragraphs 1, 2 and 4.
(5)The responsible public body may publish personal data only if the data subject has given consent or if this is indispensable for the presentation of research results concerning persons or events of contemporary history.
(6)The rights of the data subject provided for in Articles 15, 16, 18 and 21 of Regulation (EU) 2016/679 shall be restricted insofar as their exercise would be likely to render impossible or seriously impair the specific research or statistical purposes. zur Einzelansicht § 13
