§ 17 LDSG SH

Tasks and powers

(1)The Land Commissioner shall be the supervisory authority within the meaning of Article 51(1) of Regulation (EU) 2016/679. He or she shall monitor compliance with the provisions of Regulation (EU) 2016/679, this Act and other data protection provisions by public bodies. He or she shall also be the supervisory authority pursuant to § 40 of the Federal Data Protection Act for the data processing of non-public bodies.
(2)Before exercising the powers of Article 58(2)(c) to (g) and (j) of Regulation (EU) 2016/679, the Land Commissioner for Data Protection shall give the public body the opportunity to comment on the facts relevant to the decision within a reasonable period. At the same time, the competent legal or technical supervisory authority shall also be given the opportunity to comment. This may be dispensed with where an immediate decision appears necessary because of imminent danger or in the public interest, or where a compelling public interest precludes it. In such cases, the supervisory authority shall be informed after the action has been taken. § 87 of the Land Administrative Act shall remain unaffected.
(3)The Land Commissioner shall establish and publish binding criteria for certification.
(4)The Land Commissioner shall be informed in a timely manner of the Land's plans to establish or make material changes to systems for the automated processing of personal data. zur Einzelansicht § 17
