Distinction between facts and personal assessments
(1)The controller shall, in the processing, as far as possible distinguish whether personal data are based on facts or on personal assessments. For this purpose, the controller shall, insofar as this is possible and appropriate in the context of the respective processing, clearly indicate assessments based on personal evaluations as such. It must furthermore be possible to establish which body holds the records underlying the assessment based on a personal evaluation. zur Einzelansicht § 49
