§ 14 BbgDSG

Establishment

(1)The office of the State Commissioner for Data Protection and for the Right of Access to Files (the State Commissioner) shall be established under the President of the Landtag of Brandenburg. The State Commissioner shall bear the official and functional title "The State Commissioner for Data Protection and for the Right of Access to Files".
(2)The necessary staff and material resources shall be made available for the performance of the tasks. The resources shall be indicated in the budget of the Landtag in a separate chapter. Section 28(3), Section 29(3) and Section 41(1) of the Land Budget Code shall apply mutatis mutandis.
(3)The civil servants serving under the State Commissioner shall be appointed by the President of the Landtag on the proposal of the State Commissioner. The State Commissioner shall be the superior of the civil servants, who shall be bound exclusively by the Commissioner's instructions. The State Commissioner shall exercise the functions and powers of the supreme service authority for the civil servants serving under him or her. The employees shall be hired and dismissed by the State Commissioner.
(4)The State Commissioner shall appoint from among the staff a person to serve as deputy. This person shall conduct the business where the State Commissioner is prevented from exercising the office or where the official relationship ends and the State Commissioner is not obliged to continue conducting the business.
(5)The State Commissioner may delegate tasks of personnel administration and management to other Land bodies insofar as the independence of the State Commissioner is not thereby impaired. Personal data of the employees may be transmitted to those bodies insofar as knowledge thereof is necessary for the performance of the delegated tasks.
