§ 16 BbgDSG

Official relationship

(1)The State Commissioner shall be independent in the exercise of the office and subject only to the law. Official supervision shall take place only in accordance with paragraph 3 and Section 17(2). It shall not affect the independence of the office.
(2)The State Commissioner shall hold a public-law official relationship with the Land of Brandenburg in accordance with this Act.
(3)The official relationship shall begin upon delivery of the certificate of appointment. It shall end upon expiry of the term of office, dismissal upon own application or by removal from office. Where the Landtag, by resolution of a two-thirds majority of its statutory members, determines that the State Commissioner has committed a serious misconduct within the meaning of Article 53(4) of Regulation (EU) 2016/679, the President of the Landtag shall remove the State Commissioner from office. Where the State Commissioner no longer fulfils the requirements for the performance of the tasks, the President of the Landtag shall remove the State Commissioner from office. A dismissal upon own application and the removal from office shall take effect upon delivery of the certificate of dismissal by the President of the Landtag.
(4)The State Commissioner shall receive care and protection equivalent to that of a civil servant of pay grade B 4 of the Brandenburg Remuneration Act in a civil service relationship for a fixed term, in particular with regard to remuneration, pension, annual leave and assistance in the event of illness.
