Processing of personal data for the purposes of freedom of expression and information
(1)Insofar as personal data are processed in the exercise of the right to freedom of expression and information for journalistic, artistic or literary purposes, only Article 5(1)(f) and Articles 24, 32 and 33 of Chapters II to VII and IX of Regulation (EU) 2016/679 shall apply. Article 82 of Regulation (EU) 2016/679 shall apply with the proviso that liability shall arise only for damage caused by inadequate technical or organisational measures within the meaning of Article 5(1)(f) of Regulation (EU) 2016/679.
(2)Where the processing of personal data pursuant to paragraph 1, sentence 1, leads to the dissemination of counter-statements by the data subject or to declarations of undertaking, decisions or judgments on the cessation of dissemination or on the revocation of the content of the data, such counter-statements, declarations of undertaking, decisions, judgments and revocations shall be added to the stored data and kept there for the same period as the data themselves, and shall be transmitted together with the data upon any transmission of the data.
(3)Paragraphs 1 and 2 shall also apply to non-public bodies.
