§ 18 BbgDSG

Tasks and powers, cooperation obligations

(1)The State Commissioner shall be the competent supervisory authority within the meaning of Article 51(1) of Regulation (EU) 2016/679 and Article 41(1) of Directive (EU) 2016/680 in the Land of Brandenburg insofar as the scope of application of this Act is open. He or she shall also be responsible for monitoring compliance with data protection provisions where the data processing is subject neither to Regulation (EU) 2016/679 nor to Directive (EU) 2016/680.
(2)Unless this Act or other legal provisions contain derogating rules, the tasks and powers of the supervisory authority shall be determined by Articles 57 to 59 of Regulation (EU) 2016/679.
(3)He or she shall also be the supervisory authority pursuant to Section 40 of the Federal Data Protection Act for the data processing of non-public bodies in the Land of Brandenburg.
(4)The State Commissioner shall, within the scope of the tasks assigned to him or her by paragraphs 1 and 3, be competent for the prosecution and sanctioning of administrative offences.
(5)Prior to the adoption of legal and administrative provisions concerning the processing of personal data, the State Commissioner shall be heard. He or she shall be informed in a timely manner of Land planning for the establishment or material modification of systems for the automated processing of personal data, insofar as personal data are processed in those systems. The State Commissioner may make recommendations for the improvement of data protection. In particular, he or she may advise the Land government and individual members of the Land government, the municipalities and associations of municipalities as well as other public bodies on matters of data protection.
(6)For the performance of his or her tasks, the State Commissioner may, on his or her own initiative or upon request, issue opinions on all matters relating to the protection of personal data to the Landtag, the Land government, other institutions and bodies, and the public.
(7)The Landtag, its committees or the Land government may request the State Commissioner to follow up on matters and events that directly concern his or her area of responsibility.
