Establishment
(1)The supervisory authority shall be established under the President of the state parliament. The supervisory authority shall bear the official and functional designation 'The State Commissioner for Data Protection' (female form) or 'The State Commissioner for Data Protection' (male form).
(2)The necessary personnel and material resources to be made available to the supervisory authority for the fulfilment of its tasks shall be shown in a separate chapter of the budget of the state parliament. Section 27(2), Section 28(1) and Section 29(3) of the State Budget Code shall apply accordingly.
(3)The civil servants of the supervisory authority shall be appointed by the President of the state parliament on the proposal of the State Commissioner for Data Protection (member of the supervisory authority). They may only be transferred or seconded with the consent of the member of the supervisory authority. The member of the supervisory authority shall be the superior authority of the civil servants, who shall be bound exclusively by his or her instructions. These provisions shall apply accordingly to employees who are employed or are to be employed at the supervisory authority. The President of the state parliament shall ensure that the member of the supervisory authority selects and has its own personnel, which is exclusively subject to the direction of the member of the supervisory authority.
(4)The member of the supervisory authority shall determine its own deputisation arrangements. The deputy shall conduct the business when the member of the supervisory authority is prevented from exercising the office or when the official relationship has ended and the member is not obligated to continue conducting the business. zur Einzelansicht § 15
