§ 9 DSG M-V

Data processing for scientific

(1)or historical research
(2)Public bodies may process personal data, including special categories of personal data within the meaning of Article 9(1) of Regulation (EU) 2016/679, without consent for a specific research project where the legitimate interests of the data subject are not impaired by reason of the nature of the data, their public availability or the manner of their use, or where the public interest in the conduct of the research project substantially outweighs the legitimate interests of the data subject and the purpose of the research cannot be achieved by other means. In the case of a transmission, the personal data may not be processed for purposes other than research purposes.
(3)The data shall be modified as soon as the research purpose permits, in such a way that the individual details about personal or factual circumstances can no longer be attributed, or can only be attributed with a disproportionate expenditure of time, cost and effort, to an identified or identifiable natural person. Until such time, the features by means of which individual details about personal or factual circumstances can be attributed to an identified or identifiable natural person shall be stored separately. They shall be erased as soon as the research purpose permits.
(4)Public bodies conducting scientific or historical research may only publish personal data where 1. the data subject has given consent, or 2. this is indispensable for the presentation of research findings on events of contemporary history.
(5)Personal data may only be transmitted to third parties or bodies not subject to the provisions of this Act in accordance with paragraph 1 sentence 1 where they undertake to comply with the provisions of paragraph 1 sentence 2 and paragraphs 2 and 3.
(6)The right of access pursuant to Article 15 of Regulation (EU) 2016/679, the right to rectification pursuant to Article 16 of Regulation (EU) 2016/679, the right to restriction of processing pursuant to Article 18 of Regulation (EU) 2016/679 and the right to object pursuant to Article 21 of Regulation (EU) 2016/679 shall not apply insofar as the exercise of these rights would render the specific research purposes impossible or seriously impair them and such exceptions are necessary for the fulfilment of these purposes or the exercise or granting of these rights is impossible. zur Einzelansicht § 9
