Restriction of the right of access
(1)Where the provision of information to a data subject relates to personal data that have been transmitted by the controller to authorities of the public prosecution service, police departments, state fiscal authorities, authorities of the Office for the Protection of the Constitution, the Federal Intelligence Service, the Military Counter-Intelligence Service or other authorities of the Federal Ministry of Defence, these authorities shall be given the opportunity to comment in advance. The same shall apply to the provision of information relating to the transmission of personal data from these authorities.
(2)The controller may refuse a request for information insofar as and for as long as 1. the information would endanger public security or otherwise be detrimental to the welfare of the Federation or a Land, 2. this is necessary for the prosecution of criminal offences or administrative offences, or 3. the personal data or the fact of their processing must be kept secret pursuant to a legal provision or on account of the rights and freedoms of other persons.
(3)The refusal to provide information need not include a statement of reasons insofar as the communication of the actual and legal reasons on which the decision is based would jeopardise the purpose pursued by the refusal of information.
(4)Where no information is provided to the data subject, such information shall, at the request of the data subject, be provided to the supervisory authority, unless the competent supreme Land authority determines in the individual case that this would endanger the security of the Federation or a Land. The communication of the supervisory authority to the data subject shall not allow any conclusions to be drawn as to the knowledge of the controller, unless the controller has consented to more extensive disclosure.
(5)A right of access of the data subject regarding personal data stored exclusively for purposes of data security and data protection supervision shall be excluded. zur Einzelansicht § 6
