§ 2 DSG M-V

Scope of application

(1)This Act applies to authorities, public-law institutions and bodies of the Land, municipalities, offices, districts, and other legal persons under public law subject to the supervision of the Land (public bodies), where they process personal data.
(2)Legal persons and other associations under private law that perform tasks of public administration and in which one or more of the legal persons under public law mentioned in paragraph 1 hold an absolute majority of shares or votes shall also be deemed public bodies. Where a legal person or other association under private law to which this Act applies pursuant to sentence 1 participates in another association under private law, sentence 1 shall apply accordingly. Where non-public bodies perform sovereign tasks of public administration, they shall be deemed public bodies within the meaning of this Act to that extent.
(3)For the courts, as well as the authorities of the public prosecution service, the Office for the Protection of the Constitution and the State Audit Office, this Act shall apply only insofar as they perform general administrative tasks.
(4)The state parliament, its committees, its members, the parliamentary groups and their respective administrations and employees shall not be subject to the provisions of this Act insofar as they process personal data in the performance of parliamentary tasks and are required to apply the data protection rules issued by the state parliament for this purpose.
(5)This Act shall not apply to public bodies insofar as they participate in competition. The provisions applicable to non-public bodies shall apply to them in that respect.
(6)Religious communities under public law and private-law institutions associated with them shall not be subject to the provisions of this Act if, at the time of the entry into force of Regulation (EU) 2016/679, they applied comprehensive rules for the protection of natural persons during processing, and have brought these rules into line with Regulation (EU) 2016/679.
(7)The provisions of Regulation (EU) 2016/679 in conjunction with this Act shall take precedence over those of the State Administrative Procedure Act insofar as personal data are processed. zur Einzelansicht § 2
