Appointment
(1)Public bodies within the meaning of Section 17(1) shall appoint a data protection officer. A joint data protection officer may be appointed for several public bodies, taking into account their organisational structure and size. The person appointed pursuant to Article 37 of Regulation (EU) 2016/679 by the public body as data protection officer may also be appointed as data protection officer.
(2)The data protection officer shall be appointed on the basis of his or her professional qualifications and, in particular, expert knowledge in the field of data protection law and data protection practice, as well as on the basis of his or her ability to perform the tasks referred to in Section 20.
(3)The data protection officer may be an employee of the public body or may perform his or her tasks on the basis of a service contract.
(4)The public body shall publish the contact details of the data protection officer and shall communicate these data to the State Commissioner for Data Protection. zur Einzelansicht § 18
