§ 33 DSG LSA
Criminal offences
(1)Any person who, for remuneration or with the intention of enriching himself or herself or another person, or of causing damage to another person, commits an act referred to in Section 32(1) shall be punished with imprisonment for a term not exceeding two years or with a fine. The same penalty shall apply to any person who, under the conditions set out in sentence 1, combines individual details relating to personal or factual circumstances of a person who is no longer identifiable and thereby makes the person identifiable again.
(2)The attempt shall be punishable.
(3)The offence shall only be prosecuted upon application, unless the criminal prosecution authority considers ex officio prosecution to be necessary in view of the special public interest in prosecution.
