Application of the provisions on administrative fine
(1)and criminal proceedings
(2)For violations pursuant to Article 83(4) to (6) of Regulation (EU) 2016/679, unless this Act provides otherwise, Section 41(1), sentences 1 and 2, and (2) of the Federal Data Protection Act shall apply mutatis mutandis.
(3)Fines may not be imposed by the State Commissioner for Data Protection on public bodies. Sentence 1 shall not apply insofar as public bodies participate as public-law undertakings in competition.
