§ 8 DSG LSA

Optical-electronic observation

(1)The processing of personal data from publicly accessible areas by means of optical-electronic devices shall be permissible insofar as this is necessary for 1. the exercise of domiciliary rights, 2. the protection of property or possession, or 3. the monitoring of access authorisations, in particular in the implementation of technical and organisational measures for the protection of personal data, and there are no indications that the legitimate interests of the persons within the range of the device prevail.
(2)The possibility of observation must be recognisable for data subjects within the range of the optical-electronic device. Furthermore, reference shall be made to the name and contact details of the controller and to the possibility of obtaining the information pursuant to Article 13 of Regulation (EU) 2016/679 from the controller.
(3)The data may be processed for a different purpose only insofar as this is necessary to avert dangers to public safety or for the prosecution of criminal offences.
(4)The use of dummy devices shall be permissible subject to the corresponding application of paragraphs 1 and 2. zur Einzelansicht § 8
