§ 30 DSG LSA

Judicial remedy

(1)The disputes pursuant to Article 78(1) and (2) of Regulation (EU) 2016/679 and Article 53(1) and (2) of Directive (EU) 2016/680 shall be assigned to the Administrative Court of Magdeburg for the districts of all administrative courts of the Land.
(2)No preliminary proceedings shall take place.
(3)A Land authority may also bring an action for annulment against an order of the State Commissioner for Data Protection that concerns it.
(4)Where a public body does not comply with an order of the State Commissioner for Data Protection that concerns it and does not take legal action against it within one month of notification of the order, the State Commissioner for Data Protection may apply for a judicial determination of the lawfulness of the order issued.
(5)Paragraphs 1 to 4 shall apply mutatis mutandis where the State Commissioner for Data Protection does not deal with a complaint pursuant to Article 57(1)(f) of Regulation (EU) 2016/679 or Article 46(1)(f) of Directive (EU) 2016/680, or does not inform the complainant of the progress or outcome of the complaint within three months.
(6)Paragraphs 1 to 5 shall apply mutatis mutandis to orders or omissions of the State Commissioner for Data Protection that are based outside the scope of application of Regulation (EU) 2016/679 and Directive (EU) 2016/680 on other legal provisions of the Federation or of the Land.
(7)For actions by data subjects against a controller or processor on account of a violation of data protection provisions within the scope of application of Regulation (EU) 2016/679 or of the rights of the data subject contained therein, Section 44 of the Federal Data Protection Act shall apply mutatis mutandis.
