Exceptions with regard to data processing
(1)for scientific or historical research purposes and for statistical purposes pursuant to Article 89 of Regulation (EU) 2016/679
(2)Where personal data are processed for scientific or historical research purposes or for statistical purposes, they shall be anonymised as soon as the research purpose or the statistical purpose permits. Until then, the characteristics by means of which a personal reference can be established shall be stored separately. These characteristics may only be combined with the individual details insofar as the research purpose or the statistical purpose so requires.
(3)In the context of scientific or historical research projects, personal data may be published only where the data subject has given consent or where this is indispensable for the presentation of research findings on events of contemporary history.
(4)A transmission of personal data for scientific or historical research purposes or for statistical purposes to recipients to whom this Act does not apply shall be permissible where the recipients undertake to process the personal data only for the research or statistical project to be designated by them and in accordance with paragraphs 1 and 2.
(5)The processing of special categories of personal data within the meaning of Article 9(1) of Regulation (EU) 2016/679 for scientific or historical research purposes or for statistical purposes shall be lawful where the purpose of the research or the statistical purpose cannot be achieved by other means or only with disproportionate effort and where the public interest in the conduct of the research or statistical project substantially outweighs the interest of the data subject in the non-processing. The result of the balancing of interests and the reasons therefor shall be documented. The data protection officer pursuant to Article 37 of Regulation (EU) 2016/679 shall be informed of the processing.
(6)The right of access pursuant to Article 15 of Regulation (EU) 2016/679, of rectification pursuant to Article 16 of Regulation (EU) 2016/679, of restriction of processing pursuant to Article 18 of Regulation (EU) 2016/679 and of objection pursuant to Article 21 of Regulation (EU) 2016/679 shall not apply insofar as the exercise of these rights is likely to render impossible or seriously impair the achievement of the scientific or historical research purposes or the statistical purposes, and the exclusion of these rights is necessary for the fulfilment of the purposes.
