Transitional provisions
(1)The service agreements pursuant to the Land Staff Representation Act of Sachsen-Anhalt in force at the office of the State Commissioner for Data Protection established under the President of the Landtag of Sachsen-Anhalt until 5 May 2018 shall continue to apply in the office of the State Commissioner for Data Protection, which has become an independent authority, unless they expire by passage of time, termination or termination agreement.
(2)The data protection officers in office on 24 May 2018 shall be deemed to have been appointed pursuant to Article 37 of Regulation (EU) 2016/679 and Section 18. Their position and their tasks shall be governed by the provisions of Regulation (EU) 2016/679 and by this Act.
(3)Until the entry into force of a statutory data protection regulation for the audit activities of the Land Court of Audit, the Data Protection Act of Sachsen-Anhalt in the version of the announcement of 13 January 2016 (GVBl. LSA p. 24), amended by Article 1 of the Act of 21 February 2018 (GVBl. LSA p. 10), with the exception of Section 22(1), sentence 2, insofar as it refers to Article 58(2)(c) to (j) of Regulation (EU) 2016/679, shall apply to the processing of personal data in the area of the audit activities of the Land Court of Audit.
(4)Until the entry into force of an adaptation of the statutory data protection regulation for the area of security vetting pursuant to the Security Vetting and Classified Information Protection Act, the Data Protection Act of Sachsen-Anhalt in the version of the announcement of 13 January 2016 (GVBl. LSA p. 24), amended by Article 1 of the Act of 21 February 2018 (GVBl. LSA p. 10), with the exception of Section 22(1), sentence 2, insofar as it refers to Article 58(2)(c) to (j) of Regulation (EU) 2016/679, shall apply to the processing of personal data in the conduct of security vetting procedures by the competent body, in addition to the Security Vetting and Classified Information Protection Act. zur Einzelansicht § 34
