§ 10 DSG NRW

Erasure of personal data

(1)Insofar as public bodies are obliged to offer records for takeover by a public archive, the erasure of personal data shall be permissible only after the records have been offered to the public archive and have been assessed as not worthy of archiving, or the obligation for further retention pursuant to Section 4(5), sentence 1, of the Archives Act of North Rhine-Westphalia of 16 March 2010 (GV. NRW. p. 188) in the version applicable from time to time has ceased to apply.
(2)Where, in the case of non-automated data processing, erasure is not possible or is possible only with disproportionate effort due to the particular nature of the storage and the interest of the data subject in erasure is to be regarded as minimal, the right of the data subject to and the obligation of the controller for the erasure of personal data pursuant to Article 17(1) of Regulation (EU) 2016/679 shall not apply in addition to the exceptions specified in Article 17(3) of Regulation (EU) 2016/679. In this case, restriction of processing pursuant to Article 18 of Regulation (EU) 2016/679 shall take the place of erasure. Sentences 1 and 2 shall not apply where the personal data have been processed unlawfully.
